Service

These Terms of Service (“Terms”) govern your access to and use of the PropMachwebsite, applications and related services (the “Platform”). By creating an account, browsing listings, or otherwise using the Platform, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use the Platform. If you are using the Platform on behalf of an agency or other organisation, you confirm that you are authorised to accept these Terms on its behalf.

PropMach is a South African property platform that connects buyers and tenants with verified agents and agencies, and provides tools for listing, discovering and managing residential and commercial property. We are a technology provider - we are not a party to any sale, lease or mandate concluded between users of the Platform.

You must be at least 18 years old and able to enter into a binding contract to use the Platform. Some features require you to register an account.

• You are responsible for keeping your login details confidential and for all activity that takes place under your account.
• You agree to provide accurate, current and complete information and to keep it up to date.
• Notify us promptly at info@propmach.co.za if you suspect any unauthorised use of your account.

The Platform helps you search for property, contact agents, save listings and manage enquiries. Listings, area insights and other content are provided for general information only and do not constitute financial, legal or property advice.

You should independently verify any information that matters to you - including price, availability, measurements and property condition - before making a decision or entering into a transaction.

If you list property or operate as an agent or agency on the Platform, you additionally agree that:

• You hold all rights, mandates and registrations required under South African law - including a valid Fidelity Fund Certificate where applicable - to market the property and act as an estate agent.
• Every listing is accurate, not misleading, and that you have the owner’s authority to advertise it.
• You own or are licensed to use all images, plans and content you upload, and you grant PropMach a non-exclusive licence to host and display that content on the Platform.
• You will remove or update listings promptly when a property is no longer available.

When using the Platform, you agree not to:

• Post false, misleading, duplicated, fraudulent or unlawful listings or content.
• Scrape, harvest, or use automated means to access or copy data from the Platform without our written permission.
• Misuse contact details obtained through the Platform, including sending spam or unsolicited marketing.
• Interfere with, probe or attempt to gain unauthorised access to the Platform, its security, or other users’ accounts.
• Infringe the intellectual property or privacy rights of others, or breach any applicable law.

Browsing and enquiring on the Platform is free for buyers and tenants. Certain agent and agency features are offered on paid plans. Where fees apply, the price, billing cycle and inclusions are shown before you subscribe. Fees are payable in South African Rand and, unless stated otherwise, are non-refundable once a billing period has started. We may change plan pricing on reasonable notice.

The Platform, including its design, branding, text, software and databases, is owned by PropMach or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not copy, modify, distribute or create derivative works from the Platform except as permitted by these Terms or applicable law.

The Platform displays listings and content supplied by agents, agencies and other third parties, and may link to third-party websites and services. We do not control and are not responsible for that content or those services, and a link or listing does not imply our endorsement. Your dealings with any third party are solely between you and that third party.

The Platform is provided on an “as is” and “as available” basis. To the extent permitted by law, we make no warranties about the accuracy, completeness, reliability or availability of the Platform or of any listing or content on it. Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2008 or other mandatory South African law.

To the maximum extent permitted by law, PropMach and its directors, employees and partners will not be liable for any indirect, incidental or consequential loss, or for any loss of profit, data or opportunity, arising from your use of - or inability to use - the Platform, or from any transaction concluded with another user. Nothing in these Terms excludes liability that cannot lawfully be excluded.

You agree to indemnify and hold PropMach harmless from any claims, losses, liabilities and reasonable costs arising out of your breach of these Terms, your content or listings, or your misuse of the Platform.

We may suspend or terminate your access to the Platform if you breach these Terms, if required by law, or to protect the Platform or its users. You may stop using the Platform and close your account at any time. Provisions that by their nature should survive termination - such as intellectual property, disclaimers, liability and indemnity - will continue to apply.

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Your continued use of the Platform after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts for any dispute arising from them.
