Your privacy matters to us. This policy explains what personal information we collect, how we use it, and the rights you have under POPIA.

01Introduction

This Privacy Policy explains how PropMachcollects, uses, shares and protects your personal information when you use our website, applications and services (the “Platform”). We are committed to handling your information responsibly and in accordance with the Protection of Personal Information Act, 2013 (“POPIA”).

02Who is responsible for your information

PropMachis the “responsible party” (data controller) for the personal information processed through the Platform. If you have any questions, or wish to contact our Information Officer, email privacy@propmach.co.za.

03Information we collect

We collect the following categories of personal information:

  • Account details - name, email address, phone number, password and your role (buyer, tenant, agent or agency).
  • Profile and listing information - details, images and content you add when you create a profile or advertise a property.
  • Enquiries and messages - the content of enquiries you send to agents and any correspondence with us.
  • Usage data - searches, saved listings, pages viewed, and how you interact with the Platform.
  • Device and technical data - IP address, browser type, device identifiers and cookie data.

We collect this information directly from you, automatically as you use the Platform, and occasionally from agents or partners where you have engaged with them.

04How we use your information

We use your personal information to:

  • Create and manage your account and provide the Platform.
  • Connect you with agents and agencies, and route your enquiries to them.
  • Personalise search results, recommendations and area insights.
  • Communicate with you about your account, enquiries and service updates.
  • Send you marketing where you have consented, and where you can opt out at any time.
  • Keep the Platform secure, prevent fraud and abuse, and comply with our legal obligations.

05Our lawful basis for processing

Under POPIA, we process your personal information where it is necessary to provide a service you have requested or to perform a contract with you, where you have given consent, where we have a legitimate interest that is not overridden by your rights, or where we are required to comply with the law. You may withdraw consent at any time, although this will not affect processing already carried out.

06How we share your information

We may share your personal information with:

  • Agents and agencies - when you send an enquiry or choose to make contact, so they can respond to you.
  • Service providers (operators) - who host, support and operate the Platform on our behalf under appropriate confidentiality and security obligations.
  • Authorities and advisors - where required by law, or to establish, exercise or defend legal claims.

We do not sell your personal information to third parties.

07Cookies and similar technologies

We use cookies and similar technologies to keep you signed in, remember your preferences, understand how the Platform is used and improve it. You can control cookies through your browser settings, although disabling some cookies may affect how the Platform works.

08How we protect your information

We maintain appropriate technical and organisational measures - such as encryption in transit, access controls and secure infrastructure - to protect your personal information against loss, unauthorised access and misuse. No system is completely secure, but we work to keep your information safe and to notify you and the Information Regulator where the law requires it in the event of a compromise.

09How long we keep your information

We keep your personal information only for as long as necessary for the purposes set out in this policy, to provide the Platform, and to meet legal, accounting or reporting requirements. When information is no longer needed, we delete or anonymise it.

10Your rights under POPIA

Subject to applicable law, you have the right to:

  • Access the personal information we hold about you.
  • Request that we correct or update inaccurate information.
  • Request that we delete or destroy information we no longer have a basis to keep.
  • Object to processing, including direct marketing.
  • Withdraw consent where our processing is based on your consent.
  • Lodge a complaint with the Information Regulator of South Africa.

11Children's privacy

The Platform is intended for users aged 18 and over. We do not knowingly collect personal information from children. If you believe a child has provided us with information, please contact us so we can remove it.

12Cross-border transfers

Some of our service providers may process information outside South Africa. Where we transfer personal information across borders, we take steps to ensure it receives a level of protection consistent with POPIA.

13Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you through the Platform.
